DUO Magazine Music Contest Official Rules Eligibility.
Eligibility: DUO Magazine Music Contest is open to all emerging artists who are located in South Florida and to all ages. Contestants younger than 18 years of age are required to submit a Parental Permission Form that can be found at the end of these rules.By participating, you agree to these Official Rules and to the decisions of DUO Magazine, Inc. being final and binding in all respects. Void where prohibited by law, rule or regulation. Subject to all applicable federal, state, and local laws and regulations in the United States. How to Enter: Submit three (3) of your best songs (MP3s) to Giselle@DUOmagazine.com or mail CD to:DUO Magazine Music Contest 4310 Sheridan Street, Suite 202,Hollywood, FL 33021. If you are sending the form by mail, please place your full name or name of your band on the outside envelope. If you are sending it electronically, please place: DUO Magazine Music Contest and your name (or band’s name) on the subject line of the email. If you have a Press Kit (pictures and bio), please include when submitting your songs. Participants are required to include an entry form that you will find at the end of these rules along with a copy of their driver’s license or ID.• Entry fees. Register before August 24th and pay $25.00 (Save $20.00!!) Register after August 24th and pay $45.00. You may pay by check, money order or Pay Pal. Submission Requirements: • Submission must be equal to or no greater than five (5) minutes in length.• Songs can be submitted in English and/or Spanish. • Submission must NOT contain material which is (or promoting activities which are) sexually explicit, obscene, pornographic, violent, self-mutilating (e.g., relating to murder, the sales of weapons, cruelty, abuse, etc.), discriminatory (based on race, sex, religion, natural origin, physical disability, sexual orientation or age), illegal (e.g. underage drinking, substance abuse, computer hacking, etc.), offensive, threatening, profane, or harassing; or material that contains any derogatory references to the Contest Entity.• Submission must be entirely original to the Entrant and must NOT include mention or performance of any copyrighted media production including, but not limited to, music, films, books, television programming, etc., or identifying descriptions of any media property.• All musical compositions contained in the Submission must be original and wholly owned and administered by the Entrant.• Submission must NOT have been previously submitted to another Contest, broadcast on a media network or submitted to any entertainment entity that would conflict with this Contest, as determined in the Contest Entity’s sole discretion.• Submissions must NOT include third parties/people, who have not expressly authorized Entrant to feature their image, likeness or voice in the Submission or otherwise use such image, likeness or voice in accordance with these Contest Rules. Third Parties include, but are not limited to, celebrities, friends and minors who have not obtained parental consent prior to such participation. Entrants should be able to provide on request all appropriate clearances, permissions and releases for the Submission, including releases from all persons featured in the Submission (in the event an entrant cannot provide all required releases, DUO Magazine reserves the right, in DUO Magazine’s sole discretion, to disqualify the applicable Submission).• By entering DUO Magazine Music Contest, Participants grant DUO Magazine a non-exclusive right to use the materials submitted and the contents of the entries in any marketing or promotional materials that DUO Magazine, in its sole discretion, may decide to publish, distribute or use FOR CONTEST PURPOSES ONLY. • All Contest entries will become the property of DUO Magazine and will not be returned to Participants. DUO Magazine is not responsible for lost, stolen, misdirected, delayed, destroyed or illegible entries. Contest Judging: Winners will be selected by a panel of judges chosen by DUO Magazine, Inc. Judges will look for fresh new talent in five (5) different categories: 1. Hip-Hop/Rap 2. R&B 3. Pop 4. Latin / Reggaeton5. Rock Submissions will be scored based on the following criteria to select the five (5) Finalist Submissions: Creativity/Originality: 25%Lyrics and melody: 25%Vocals and rhythm: 25%Entertainment Value and Appeal: 25% Materials / Rights In Submissions / Publicity Rights: In consideration of a Submission being reviewed and evaluated for this Contest, each Entrant hereby grants to DUO Magazine the non-exclusive irrevocable, fully paid, universal license to use, copy, sublicense, transmit, distribute, publicly perform, publish, delete or display such Submission, or any portion thereof, including to the extent applicable (a) any information, biographical data, and material (e.g., the “Creative File”) submitted by Entrant in connection with the Contest; and (b) all video, audio, photographs, text, graphics, statements, any other creative materials, and quotations of or by Entrant and furnished by Entrant as part of this Contest (the “Material”) included in and/or submitted by Entrant in connection with the Contest), in any media now known or hereafter devised including, but not limited to, all forms of electronic media, print media and all forms of internet and wireless protocol. Each Entrant understands that his or her name and other Material may be posted on the Website in connection with Contest. Entrant agrees that DUO Magazine have no obligation to post a Submission or any Material on the Website. Each Entrant authorizes DUO Magazine to utilize, for eternity and in any manner they see fit, the Submission provided to Contest Entity, and to make derivative works from such materials solely in connection with the Contest (i.e., without limitation, to create promotional materials). Each Entrant releases the Contest Entity, and their assigns and licensees, from any and all claims or liability (now known or hereafter arising), including but not limited to any claims for defense and/or indemnity, in connection therewith. Each Entrant agrees and acknowledges that participation in the Contest, including, without limitation, the Entrant’s decision to provide the Submission to the Contest Entity for purposes of the Contest, shall not give rise to any confidential, fiduciary, implied-in-fact, implied-in-law, or other special relationship between the Contest Entity and Entrant, does not place the Contest Entity in a position that is any different from the position held by members of the general public with regard to elements of the Entrant’s Submission, and that the only contracts, express or implied, between the Contest Entity and Entrant is as set forth in these Official Rules and the release forms. In addition, by participating in the Contest and providing a Submission, each Entrant hereby grants permission (except where prohibited by law) for the Contest Entity to use Entrant’s Submission, name, likeness, voice, quotes, comments, biographical information, photograph and/or image for the purpose of advertising, trade, or promotion without further compensation or consideration in any and all media now known or hereafter developed throughout the universe. Except as required by law or permitted pursuant to these Contest Official Rules, DUO Magazine will not share an Entrant’s information with any third parties. Prize and Winners Notification: We will keep you posted of every step of the Contest. We will post on our website (www.DUOmagazine.com) a list of all the participants along with their MySpace page or website so you can check out your competition. Judges will select three(3) finalists in each category who will be announced once the judging process is done. You will be notified by email or phone as to whether or not you have been selected as a finalist. Finalists will perform live at the DUO Magazine Music Contest Finals where judges will select the winners of each category. Date and South Florida venue of the finals will be announced at a later date. The winner of each category will be given an editorial in DUO Magazine! Winners will be styled by our Fashion Director and photographed by our professional photographers. As part of your prize you will get a CD with all the pictures of your photo shoot and a case with copies of DUO Magazine with your article in it! Representations And Warranties/Indemnification: Each Entrant represents and warrants as follows: (i) the Submission is the Entrant’s own original, previously unpublished, and previously unproduced work; (ii) the Submission does not contain any computer virus, is otherwise uncorrupted, is wholly original with Entrant, and as of the date of submission, is not the subject of any actual or threatened litigation or claim; (iii) the Submission does not and will not violate or infringe upon the intellectual property rights or other rights of any other person or entity; (iv) you have obtained permission to submit the names of any band members, their personally identifiable information and their performances contained in the Submission; and (v) the Submission does not and will not violate any applicable laws, and is not and will not be defamatory or libelous. Each Entrant hereby agrees to indemnify and hold the Contest Entity harmless from and against any and all third party claims, actions or proceedings of any kind and from any and all damages, liabilities, costs and expenses relating to or arising out of any breach or alleged breach of any of the warranties, representations or agreements of Entrant hereunder, or from Entrant’s participation in the Contest. Organizers’ Decisions DUO Magazine reserves the right to modify the rules and regulations at any time and to make all decisions that it believes to be useful for the application and interpretation of the rules and regulations. DUO Magazine also reserves the right to modify, extend, cut short, suspend or cancel the contest, without notice, in the light of any circumstances beyond its control. If for any reason DUO Magazine Music Contest is cancelled your entry fee of $25 will be return. Privacy Policy By entering the Contest, you grant DUO Magazine permission to share your email address and any other personally identifiable information with the corresponding Contest Entity solely for the purpose of contest administration, judging and prize fulfillment. DUO Magazine will not sell, rent, transfer or otherwise disclose your personal data to any third party other than the corresponding Contest Entity as described above herein.
